Terms of Service

1. Agreement to These Terms

By creating an account, starting a trial or otherwise using the Services, you agree to these Terms. If you are using the Services on behalf of a school, company or other organisation, you confirm you have authority to accept these Terms for it. If you don't agree, don't use the Services.

You must be at least 13 years old to use DueToday. If you are under 18 (or under the age of majority where you live), you may only use the Services with the permission of a parent or guardian. Where the GDPR or UK GDPR applies and you are below your country's age of digital consent (between 13 and 16), a parent or guardian must give consent for you. Our Privacy Policy explains how we handle information about younger users.

2. Your Account

You're responsible for the information you give us, for keeping your login details secure and for everything that happens under your account. Tell us straight away at hello@duetoday.ai if you think your account has been accessed without permission. One person per account: don't share logins.

3. Free Trial, Subscriptions and Billing

There is no free plan. New accounts can start a free trial of DueToday Pro of up to 7 days. Before you start, the trial screen shows how long your trial lasts and whether a valid payment card is required to start it. Each person, account and payment card is eligible for one free trial; if we detect a repeat trial, the subscription may start immediately without a trial period.

If you added a payment card, then unless you cancel before the trial ends, your subscription starts automatically when the trial ends and your card is charged the price shown at checkout (currently $15 per month or $99 per year, plus any applicable taxes). If you started your trial without a payment card, nothing is charged: your trial ends on its end date unless you add a card and choose to continue. Subscriptions renew automatically at the end of each billing period until cancelled.

Payments are processed by our payment provider, Stripe. You authorise us to charge your payment method for each billing period. If a payment fails, we may retry it and your access to paid features may be limited until the balance is paid.

You can switch between monthly and annual billing in the billing portal. Upgrades take effect immediately and are charged the prorated difference; downgrades take effect from the next billing period. We may change our prices; any change applies from your next billing period after we give you reasonable notice, and you can cancel before it takes effect.

Subscriptions bought through the Apple App Store or Google Play are billed and managed by Apple or Google under their terms, including cancellations and refunds.

4. Cancellation and Refunds

You can cancel at any time from your account settings or the billing portal. When you cancel, you keep access until the end of the period you've already paid for, and you won't be charged again. Cancelling during the free trial means you won't be charged at all.

Except where required by law or described in our Refund Policy, payments are non-refundable and we don't provide refunds or credits for partial billing periods. Nothing in these Terms limits any rights you have under consumer protection laws that apply to you.

5. Referral Credits and Promotions

If someone signs up with your referral link and their first payment succeeds, you and they may each receive account credit equal to one month of your own plan, up to 12 referral credits per person in any 12-month period. Credits are applied to future invoices, have no cash value and can't be transferred. Self-referrals, fake or duplicate accounts and other abuse make credits void, and we may remove credits obtained that way.

Discount codes and promotions are subject to the terms shown with them (for example, eligible plans and expiry dates), can't be combined unless we say so, and may be withdrawn at any time before they're redeemed.

6. Teams and Schools

A team owner can add members to a team and is responsible for paying for team seats (currently $12 per seat per month) and for how the team uses the Services. Team members' access depends on the team's subscription. If you use DueToday through your school or employer, its agreement with us and its policies may also apply.

7. Your Content

You keep all rights to the lectures, documents, notes, recordings and other material you upload or create ("Your Content"). You give us a limited licence to host, store, process and display Your Content only as needed to provide and improve the Services for you, including sending it to the AI service providers we use to generate your notes, flashcards, quizzes and answers. We don't use Your Content to train AI models, and it's private by default unless you choose to share it.

You're responsible for having the rights to upload Your Content, including permission to record lectures where your institution or local law requires it.

8. AI-Generated Output

DueToday uses artificial intelligence to generate notes, summaries, transcripts, flashcards, quizzes, explanations and other output. AI output can be incomplete or wrong. Check important information against your course materials, and don't rely on DueToday for medical, legal, financial or other professional advice. Subject to these Terms, you may use the output you generate for your own study and teaching.

9. Acceptable Use

Don't use the Services to:

• break the law or infringe anyone's intellectual property, privacy or other rights;
• upload malware or content that is unlawful, abusive, hateful or sexually explicit;
• access other people's accounts or data, or probe, scan or disrupt our systems;
• scrape, copy or resell the Services, or use them to build a competing product;
• get around usage limits, security measures or trial and referral rules.

10. Academic Integrity

DueToday is a study tool. You're responsible for following your school's or university's rules on AI use and academic integrity. Don't submit AI-generated output as your own work where that isn't allowed.

11. Our Intellectual Property

The Services, including our software, design, logos and content we provide (but not Your Content), belong to DueToday and its licensors and are protected by law. We give you a personal, non-exclusive, non-transferable licence to use the Services in line with these Terms while your account is active.

12. Third-Party Services

The Services may connect to or rely on third-party services (for example, payment processing, AI providers, YouTube, Google or Notion). Your use of those services is governed by their own terms, and we're not responsible for them.

13. Suspension and Termination

You can stop using the Services and delete your account at any time. We may suspend or close accounts that break these Terms, put others at risk or are needed to comply with the law. Where reasonable, we'll tell you first and give you a chance to export Your Content. Sections that by their nature should survive termination (such as payment obligations, disclaimers and limitation of liability) continue to apply.

14. Disclaimers

To the extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, including that they will be uninterrupted, error-free or that AI output will be accurate. We don't guarantee any particular grade or exam result.

15. Limitation of Liability

To the extent permitted by law, DueToday won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or opportunities. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.

16. Indemnity

To the extent permitted by law, you agree to defend and indemnify DueToday against claims arising from Your Content or your breach of these Terms.

17. Changes to the Service and These Terms

We improve DueToday all the time and may add, change or remove features. We may update these Terms; if a change is material, we'll let you know by email or in the app before it takes effect. Continuing to use the Services after the change means you accept the updated Terms.
